Help with speeding offences

The continuing growth in the number of speed cameras and the increasing technological advances in their designs means that there is an ever greater chance that you will, at some time, be caught on a speed camera.

If you have been caught on a speed camera then, depending upon the type of camera, it is highly likely that you will receive notification of this. You will be made aware of this when you receive the Notice of Intended Prosecution (NIP). Normally this must be served upon the registered keeper of the vehicle within fourteen days of the offence being committed (not including the day of the offence) although this may be longer if the police have been unable to identify the registered keeper and can show due diligence in the steps which they have taken to achieve that identification.

If you have not as yet received notification within that 14 day period, then this may be for one of a number of reasons, including:

• the camera that flashed you was not fully operational
• the police are still trying to track down the registered keeper of the vehicle
• you are not the registered keeper (for example a company car or hire care) and the registered keeper has not yet identified you as the driver

We would suggest that you do not contact keepmedriving until such time as you have received the NIP form or until such time as you know that the registered keeper has named you as the driver at the time of the offence.

Please note in particular that the technology only works so long as it is set up correctly. Therefore there may be potential defences if calibration is in issue or Association of Chief Police Officer’s guidance has not been followed.
